This agreement is between Peter Toner (the “Agent”), Prudential California Realty (the “Company”) and you, the www.sandiegorealestateagent.com (the “Website”) website visitor ("User") as entered in the name fields on the Registration/Login Section of this website.
In consideration for the services being delivered to User on this website by the Agent the Agent and the Website, User agrees to the following terms and conditions:
1. User asserts that User is a bona fide buyer or seller of real estate.
2. User has not signed any agreement with a real estate agent or brokerage that would prevent User from entering into an agreement with the Company or the Agent. User is not working with another real estate agent or brokerage on a formal or informal basis for any transaction that might occur here.
3. User agrees and understands that customized searches requested of the Agent will be restricted to User's price range, and that User further acknowledges that User’s initial search price range is within User's general area of affordability.
4. User agrees that User will not contact the seller of any property introduced to User by the Agent, the Website, or the Company, nor will User attempt to view a property or speak with an owner unless through an appointment set by the Agent or Agent’s Buyer Agents.
5. User acknowledges that when property showings commence, User may be requested to enter into the California Association of Realtors® Exclusive Right To Purchase/Lease, Buyer Broker Agreement with the Agent and the Company
6. User agrees that the Agent and the Company may represent other prospective buyers seeking to purchase properties that may meet User's criteria;
7. User agrees to avoid the use of profanity, expletives, derogatory comments or any terms or phrases that discriminate based upon race, color, sex, religion, handicap, familial status or national origin in any communications on or through this website; and,
8. User agrees to abide by all copyright restrictions placed on the content of the Website including, but not limited to, any material or data compilations where the copyright is held by the Agent, the Company, the Website or others.
9. User agrees that The Agent and the Website offers you access to the Website Web site solely for your personal and non-commercial uses. User agrees that User will not use the Website Web site, in whole or in part, for any purpose that is unlawful or prohibited by these Terms of Use or for any purposes other than those that are personal and non-commercial. You agree that you will not modify, distribute, publish, license, create derivative works from, frame in another Web page, use on any other web site, transfer or sell any information, software, lists of Users, databases or other lists, products or services provided through or obtained from the Website Web site and except for personal and non commercial purposes, you agree that you will not copy, reproduce or transmit any information obtained from the Website Web site. User agrees that in no event shall The Agent, The Website and/or The Company be liable for any direct, indirect, incidental, special or consequential damages arising out of or in any way connected with the use of this web site or with the delay or inability to use this web site, or for any information, products, and services obtained through this web site, or otherwise arising out of the use of this web site, whether based on contract, tort, strict liability or otherwise, even if The Agent, The Website or The Company have been advised of the possibility of damages.
12. User understands that the information, software, products, and services published on the The Website site may include inaccuracies or typographical errors. User understands that The Agent is providing this site and its contents on an "as is" basis without warranty of any kind.
